You're taking a live look at the confederate monument outside the madison county courthouse.

Tonight -- the alabama attorney general's office says the madison county commission has not contacted it about the statue's future and a legal way to move it.

This comes as activists in huntsville continue to demand the statue come down and be moved elsewhere -- legally or not.

Waay 31's will robinson-smith is live outside the courthouse -- where the statue was vandalized this morning - and a rally was held tonight.

He spoke with protesters and the alabama attorney general's office about the next steps.

Like you said... the ball is in the county commission's court right now.

Folks who were out here protesting say it's past time to protesters here say they need look to place like mobile that signed a memorandum of understanding with the attorney general's office before moving a statue there.

They say that would be the fastest way for the monument to be removed.
